Privacy Policy

This Privacy Policy (“Policy”) explains how the Archicheck LLC (“Company,” “us,” “we”) collects, uses and stores information collected on The Archicheck website located at https://thearchicheck.com (“Website”).  Your use of the Website is your acceptance of the Policy and your consent to the collection, usage and storage of user information as described herein.  If you do not accept the Policy or consent to its terms, please do not use the Website.  This Policy applies to information collected on our Website, only.  

Information We Collect

The Company collects two types of information from Website users:

  • Personally Identifiable Information:  information that personally identifies you on its face or can be used to personally identify or contact you.  Some examples are your name, Social Security number, address, e-mail address and telephone number.
  • Non-Personally Identifiable Information:  information that does not personally identify you in any way and would not enable others to contact you.  Some examples are your demographic information (age, gender), user IP address, browser type, domain name, and other anonymous data about your use of the Website. 

You are not required to provide us with Personally Identifiable Information to use our Website. However, should you decide to purchase The Archicheck Program (“Program”), you will need to create a user profile and enter your billing information.  By completing these actions, you are authorizing the Company to collect, store and use the information provided in accordance with this Policy.

Your browser may automatically provide Non-Personally Identifiable information to all of the places you visit online, including our Website.  It is possible your browser informs us of the website you last visited (known as the “referring URL”) before arriving at our Website and the time and date of your visit to our Website.  This information is collected by cookies, and is discussed in the How We Use Cookies section of the Policy.

If you are uploading images to the Website, please upload them without embedded location data (EXIF GIFS).  Otherwise, Website users may be able to download and extract location data from your images. 

How We Use Your Information

We use your Personally Identifiable Information internally for administrative purposes, marketing, user account administration, site maintenance and to improve the products and services we offer through the Website.  We use Non-Personally Identifiable Information to facilitate Website operations, to understand how the Website is used by users and to make the Website more effective and efficient for users.  

Sharing Personally Identifiable Information

We may share Personally Identifiable Information with vendors and third parties solely to support the internal operations of the Website (for example, email services or technical support). These vendors and/or third parties will not use your Personally Identifiable Information for any other purpose, and such use shall only be at our discretion and in accordance with this Policy. 

It is possible that we would be legally compelled to disclose Personally Identifiable Information, such as in response to a subpoena or in connection with an investigation of fraud, actual or alleged intellectual property infringement, or other activity that is illegal or may expose you or us to legal liability.

Other than in the scenarios described above, the Company shall not sell, trade, rent, or otherwise disclose your Personally Identifiable Information without your consent.  In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, user information may be transferred to our new owner, but only in accordance with applicable law and this Policy.

How We Use Cookies

Cookies and GIFs give us information about Website traffic and activity on our Website.  We use these tools to enhance the Website and your experience on it.  All visitors to our login page receive a temporary cookie to determine if their browser accepts cookies.  This temporary cookie does not collect any Personally Identifiable Information and is discarded when you close your browser.  If you proceed to log into the Website, we set up cookies to remember your login information and screen display choices.  This makes your return visits more convenient.  Login cookies last for two (2) days, but if you click “Remember Me” they last for two (2) weeks.  When you log out of your account, the login cookies disappear.  Screen display cookies remain for one (1) year.  If you upload information to our Website, another cookie will be saved to your browser.  This cookie lasts for one day and does not collect any Personally Identifiable Information.

Most web browsers are initially set up to accept cookies. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent.  Please note, however, that certain features of our Website might not function if you delete or disable cookies.

Embedded Data and Third-Party Websites

Content uploaded to the Website from other sources may have the capability of collecting information about your activity and interaction with such embedded content. This information is governed by the privacy policy of the originating source.  We are not responsible for any cookies or tracking tools contained in this embedded content.

Retaining and Safeguarding Your Information

We retain your Personally Identifiable Information and Non-Personally Identifiable Information for no longer than is necessary to fulfill the purpose for which it was collected, or longer if required for administrative, legal or security reasons. We use reasonable and current methods to ensure the security and integrity of any information you provide to us. Users can see, edit or delete information provided to set up an account on our Website, and with the exception of their username, can modify such information.  Users can also request we delete any Personally Identifiable Information we have collected can receive an exported file containing such information. You may also contact us at any time to change your account information or delete your account from our database.

We store your information on a secure server and use SSL encryption.  However, nothing on the Internet or any method of electronic storage is 100% secure. Therefore, while we use commercially acceptable means to protect your Personally Identifiable Information, we cannot guarantee its absolute security. 

Sometimes Non-Personally Identifiable Information and Personally Identifiable Information are combined.  When this happens, the combined information is treated as Personally Identifiable Information.

Children

We do not knowingly collect any Personally Identifiable Information from children under the age of thirteen (13), or direct or market the Website towards children under such age.  If you have reason to believe an individual under the age of 13 has submitted Personally Identifiable Information to us via the Website, please contact us immediately so that we can remove it.

California Users and Customers

California Civil Code Section 1798.83 permits California residents to request information from the Company about the disclosure of their Personally Identifiable Information to third parties. You may request this list of third parties by sending an e-mail to info@thearchicheck.com.

EU Users and Customers

The General Data Protection Regulation (“GDPR”), requires additional protections for the Personally Identifiable Information of Website users who are citizens of member states of the European Union. The definition of Personally Identifiable Information is broader under EU regulations, and can include IP addresses, responses to surveys, social media identifiers and posted photographs.

Under the GDPR, EU citizens have the right to request the following: (i) what Personally Identifiable Information we hold about you, and for what purpose; (ii) access to such information; (iii) the right to make corrections to the information; (iv) the right to object to our use of the information and withdraw consent for our use of the information; (v) the right to have your Personally Identifiable Information deleted from our database, transferred back to you or to another data controller.  Any GDPR request must be sent to: info@thearchicheck.com.

Updates

We may update these Terms at any time and without notice.  However, any updates will be posted on the Website, and will be effective once posted. We recommend checking the Website periodically for updates.

General

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its internal law governing conflict of laws. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the State and Federal courts located in Suffolk County, New York.  If any provision of these Terms is deemed invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any of these Terms shall be deemed a waiver of any other term, and Company’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
